Notice of Extraordinary Council Meeting

Extraordinary meeting of Council to be held Thursday 15 August

The Harvard Room at Tweed Heads Administration Office.

An Extraordinary meeting of Council will be held on Thursday 15 August following a rescission motion by Councillors Chris Cherry, Meredith Dennis and Nola Firth relating to the Gales Holding development application DA23/0438.

The meeting will be held at 6.30 pm in the Harvard Room at the Tweed Heads Administration Office in Brett Street, Tweed Heads.

The meeting will be held in Confidential Committee as the debate will relate to matters that are subject to legal professional privilege.

The meeting relates to a single agenda item, seeking to rescind the resolution from Item 22.1 of the Council Meeting held on 1 August 2024 – Notice to Alter – Cr Polglase, Cr Brinsmead, Cr Owen - Appeal Management DA23/0438, being:

"that:

  1. The Mayor and the General Manager (or delegate) undertake Appeal Management of DA23/0438 by way of negotiated conditions for approval as per the attached confidential Notice to Alter.
  2. ATTACHMENT 1 is CONFIDENTIAL in accordance with Section 10A (2) of the Local Government Act 1993, because it contains:
  3. (g) advice concerning litigation, or advice that would otherwise be privileged from production in legal proceedings on the ground of legal professional privilege".

Development Application DA23/0438 was for a change of use of fill material and delivery method on an approved fill site at the Gales Holdings development at Kingscliff.
