Tree removal on private property: what you need to know

Following the impacts of ex-Cyclone Alfred, Tweed Shire Council is providing additional advice for residents dealing with fallen or damaged trees on their property.

Council typically requires landowners to obtain a permit to remove certain trees on private non-rural zoned land. While the rules have not changed, we are here to assist landowners. Here’s what you need to know:

Do you need a permit?

  • No permit needed to remove trees that have already fallen.
  • If you have a tree on your property that has been badly storm damaged and it is an imminent risk, Council may be able to issue a rapid approval. To apply:
    • Email clear photos of the tree showing the risk to: treepermits@tweed.nsw.gov.au
    • Contact a local Level 3 accredited arborist to assess the tree. The arborist should call or email Council with their findings and any additional evidence required. Findings and evidence can be emailed to: treepermits@tweed.nsw.gov.au
  • Light pruning (up to 20% of the living canopy) is allowed without a permit. It must be done by a minimum Level 3 accredited arborist in accordance with the relevant Australian Standard.
  • Trees within 5 metres of your house may be eligible for removal without a permit. This exemption does not include trees on council property, threatened species, koala food trees and very large trees (greater than 800mm diameter at breast height).
